Do You Think The Smoking Ban Infringes On The Rights Of The Landlord?
If someone owns a pub and decides they want to allow smoking isn’t it against their rights to ban it when it’s their business decision?

Yes, of course it is. Customers and employees should have a free choice. Also, the ‘intolerants’ have a free choice, they don’t have to go in and impose their prissy attitudes on others. Those, in fact, that are more concerned with socialising than obsessing about their health.
What would these ‘intolerants’ do if a lobby was got up to ban alcohol on the grounds that it was for the greater good? Don’t think that it isn’t possible.

It infringes on everyones rights make choices for themselves. I realise the reason for the ban on smoking but surely they could of allocated smoking areas which were enclosed. Many pubs are closing as smokers no longer go out to drink in them choosing to stay at home instead. I am sure the government did not want this to happen but it has. Once again the working class are the biggest group to be affected.

No, not at all because they cant make the decision whether they want to endanger the lives of others around them. That’s like saying, the landlord can have guns or drugs in his pub because it’s their business decision?
We have laws for a reason.
Plus smoking is evil and should be banned.

Yes I do agree. There are a number of Free Houses in the West country. I would go even further by allowing smoking areas INSIDE all pubs. I live in Bulgaria where smoking is allowed in all pubs and most restaurants all of which have excellent ventilation fans., something that could easily be done in Britain.

No. I think it’s a triumph for us non-smokers who have had our rights to breathe clean air violated for too long. I no longer have to avoid wearing certain clothes or getting sick from the smoke when I go out. (My eyes would burn from the smoke. I’ve become very allergic.) I also would smell awful.
I think smoking should be banned from all public places. It’s disgusting.
People can still smoke away from other people. They have to be more considerate now. What a shame. Not.
edit: People are allergic to parfum so I wear a lot less. Oh well. So it goes.
If smoking did not infringe on the rights of other people (affect other people) then this wouldn’t even be an issue.

I think an awful lot of landlords agree with you – the smoking ban has caused a massive drop in trade, and landlords had no choice in this and are now in financial difficulty

No because the staff would still have to suffer the smoke. Roy Castle, the entertainer died of lung cancer because of years spent working in smokey atmospheres. He had never been a smoker himself.

no it doesnt, how many landlords actually own their own pubs ??
nothing to do with business decision, its the law, anyone found breaking it is dealt with accordingly

They can allow people to smoke in the living area of the pub(if they really wanted to), but not the public side.

It infringes on everyones right to choose for themselves. It ain’t going to change though.

No it doesn’t if the landlord wants smoking then he has to provide an outside room. Best thing the government ever did.(The only best thing).
February 10th, 2010 at 2:33 am
No, alas the law is the law.
February 10th, 2010 at 4:04 am
Absolutely. Because non-smokers can choose not to go there.
February 10th, 2010 at 8:59 am
Undoubtedly; but this is the name of the game these days.
February 10th, 2010 at 2:38 pm
no but it infringes on the rights of smokers
February 10th, 2010 at 6:31 pm
No. Pubs are a place of work just like an office, factory or restaurant.
February 11th, 2010 at 1:29 am
No.

Yes, it does infringe on individual liberties, both for the smoker and the establishment owner, BUT IT’S FOR THE BETTER GOOD.
